On 8 September 2025, we sent a letter to ESMA ahead of the meeting of their Investor Protection Standing Committee, which is discussing the regulatory treatment of perpetual contracts in crypto-asset markets and their potential classification as Contracts for Differences (CFDs). The letter outline our concerns and recommendations for perpetual contracts to be classified as derivatives in the same way as other instruments, with their treatment determined by the underlying asset.
